Trade Agenda Hits Impasse

While White House and Congressional negotiators have reportedly made some progress toward a bipartisan compromise on the lapsed Trade Adjustment Assistance (TAA) program -- described by the White House as essential to moving the pending FTAs with Korea, Colombia, and Panama -- a deal continues to be elusive. Disagreements continue over the appropriate legislative vehicle to move TAA and the lapsed trade preference programs (ATPA and GSP). House Ways and Means Trade Subcommittee Chairman Kevin Brady (R-TX) had indicated that informal "mock mark ups" on the trade agreements could happen during the week of June 20, but they were never scheduled as discussions with the Administration continue. The House is in recess the week of June 27 and the Senate is in recess the week of July 4. The Chamber, which serves as the secretariat of the Latin America Trade Coalition and the U.S.-Korea FTA Business Coalition, continues to push lawmakers for prompt action on the entire trade agenda including the FTAs, TAA, ATPA and GSP.

At a Trade Negotiations Committee (TNC) meeting in Geneva on June 22, WTO Director-General Pascal Lamy stressed that members "need urgently to have clarity about what we can and cannot do by the Ministerial Conference in December so that we can get down to work without further delay," according to his prepared remarks . Lamy suggested focusing a Ministerial package on trade benefits for the poorest countries and perhaps such additional issues as "trade facilitation, export competition, S&D Monitoring Mechanism, a step forward on fisheries subsidies and a step forward on environmental goods and services." He said this would mean "loads of work and challenges ahead and no guarantee of success, but, in my view it is worth trying -- and it is our duty to do so."

U.S. Chamber Urges Reauthorization of Ex-Im Bank

On Wednesday, the House Financial Services Committee approved by a voice vote H.R. 2072, the Securing American Jobs Through Exports Act of 2011, which would reauthorize the charter of the U.S. Export-Import Bank (Ex-Im Bank) through September 30, 2015. Last Friday, the U.S. Chamber joined with 15 other associations to send a letter to House Financial Services Committee Chairman Spencer Bachus and his fellow committee members urging them to support H.R. 2072. It reads in part: "This bill is the result of a bipartisan effort by both the Committee and Subcommittee leadership of the House Financial Services Committee to craft a bill that will help grow and sustain U.S. exports and U.S. jobs, which is the mandate of the Ex-Im Bank. As the Bank's Charter expires on September 30th, it is imperative that this bill move forward swiftly."

Commerce Nominee John Bryson Testifies before Senate Commerce

On June 21, the U.S. Senate Committee on Commerce, Science, and Transportation held a hearing on the nomination of John Bryson to be Secretary of the U.S. Department of Commerce. Mr. Bryson stated : "The perspective I've gained in the private sector is a big reason President Obama asked me to serve and brings value to the voice I will have within the Cabinet. It will also help me reach out to America's business community. They're on the economic front lines every day and, if confirmed, the President expects me to be able to tell him about the challenges they're facing so that this Administration does everything it reasonably can to make it easier for them to create jobs and grow. If confirmed, it will be an honor to lead an agency that does so much to further that goal".

Chamber Opposes Amendment to Bar IMF Support

On June 23, the Chamber sent a letter to the Senate opposing an amendment offered to S.679, the "Presidential Appointment Efficiency and Streamlining Act of 2011," by Senator DeMint which would bar the United States from participating in the International Monetary Fund's New Arrangements to Borrow (NAB). The amendment was originally to be considered later that day but was deferred to June 28. The letter reads in part: "With leadership from the United States, the G20 committed during the global financial crisis to strengthen the IMF by creating the NAB, which is based on the principle that an ounce of prevention is worth a pound of cure. With other governments providing more than 80 percent of the new funding required, this U.S. commitment will ensure the IMF has adequate resources to mitigate international financial crises... Passage of this amendment would likely be viewed as a move by Washington to withdraw from the IMF itself... Without adequate IMF support, financial crises in foreign markets may negatively impact U.S. jobs and exports and undermine the U.S. economic recovery."

Compartimos con ustedes el TIP´s 22-2011 que la firma tributaria FIDESBURó, socia de AmCham Guayaquil, ha desarrollado el cual trata sobre la Irretroactividad de la aplicación del recargo tributario del 20% sobre glosas determinadas por la administración.

En el Registro Oficial No.471, del jueves 16 de junio de 2011, se publicó la Resolución emitida por la Corte Nacional de Justicia, mediante la cual declara la No Retroactividad de la aplicación del recargo del 20% en materia tributaria como precedente jurisprudencial obligatorio, por la triple reiteración de fallos sobre ese mismo punto de derecho.

1. Recargo Tributario: El Art.90 del Código Tributario, modificado por la Ley Reformatoria para la Equidad Tributaria en el Ecuador - LRETE (publicada en el Registro Oficial No.242, de diciembre 29 de 2007) estableció una sanción para aquellos casos en que la administración tributaria ejerza su facultad determinadora:

"La obligación tributaria así determinada causará un recargo del 20% sobre el principal".

El 11 de agosto del 2009, el Consejo Empresarial para el Desarrollo Sustentable - CEMDES y la Cámara Ecuatoriano Americana de Comercio,

Guayaquil AMCHAM, suscribieron un Convenio de Cooperación Interinstitucional que tiene como objetivo general promover los conceptos y prácticas de Responsabilidad Social entre ambas instituciones. Este Convenio
dirigido para las empresas miembros de AMCHAM y se ha enfocado en 2 etapas: 1.Un "Programa de Formación en RSE" orientado para conocer,distinguir y reflexionar sobre la aplicación de la política de Responsabilidad Social Empresarial como sistema de desarrollo

corporativo por el que se genera Rentabilidad en triple dimensión: económica, social y ambiental, según los nuevos parámetros que impone el mercado; y, 2.Evaluación en implantación del sistema en las empresa que lo adopten. Cuenta con el apoyo del consultor John Chiriboga Ycaza, Máster en Dirección de Empresas y Diplomado en RSE (Universidad Adolfo Ibáñez, Chile).

El Programa de Formación está dividido en módulos escritos con los temas formativos en RSE, y charlas presenciales de apoyo. Dirigido a personas que se desempeñen en puestos de decisión y operación ejecutiva en las empresas miembros de AMCHAM. Al término de cada módulo conocerán las ventajas del sistema y características de su aplicación en el tema quincenal presentado.

On June 15, the U.S. Chamber of Commerce unveiled the website www.TradeSupportsJobs.com , offering unprecedented details on U.S. exports and the jobs they support for all 50 states and all 435 Congressional Districts, as the business community intensifies its advocacy for the trade agreements with South Korea, Colombia and Panama. "With facts and arguments, we'll win this trade debate and get these deals done," said U.S. Chamber President Tom Donohue at the press event to launch the website and outline the Chamber's nationwide lobbying efforts in support of the trade agreements. "For the first time, this site makes available lists of thousands of companies that are exporting, in every state and every district. We need these facts and arguments more than ever because we need these trade agreements more than ever." Information on the site was widely circulated on Capitol Hill, with leadership offices calling it "outstanding." The House Ways and Means Committee staff circulated a press release calling attention to the site as well.

Colombia Meets June 15th Milestones Under Action Plan on Labor Rights

On June 13, the Office of the U.S. Trade Representative announced that Colombia had met the specific "milestones" slated for completion by June 15 under the bilateral labor action plan on labor rights - removing the final barrier to submitting the long-pending U.S.-Colombia trade agreement to Congress. Under the action plan, which was announced by President Obama and President Santos on April 7, the Colombian government committed to take a series of measures to improve the protection of internationally recognized labor rights, the prevention of violence against labor leaders, and the prosecution of the perpetrators of such violence. U.S. Trade Representative Ron Kirk said: "The Action Plan is designed to significantly increase labor protections in Colombia, and we are pleased that Colombia is meeting its commitments. We are eager to see Congress move the Colombia trade agreement forward as soon as possible along with the Korea and Panama agreements and a renewal of Trade Adjustment Assistance. It's time to seize the market-opening, job-supporting opportunities of the pending trade agreements for American businesses, farmers, ranchers and workers."

House Votes to Bar Payments to Brazil relating to WTO Cotton Case

During debate of the House Agriculture Appropriations FY2012 bill this week, Representatives Rosa DeLauro (D-CT) and Ron Kind (D-WI) offered amendments to bar the transfer of U.S. funds for technical assistance and capacity building to Brazil in connection to the WTO cotton case. The DeLauro amendment was defeated, but the Kind amendment was approved. Last year, the United States and Brazil reached a temporary agreement to avoid Brazilian trade retaliation of almost $1 billion against U.S. goods and intellectual property rights. The transfer of funds was one of the agreement's five pillars and its elimination would trigger sanctions by Brazil. The Brazil Trade Action Coalition (BRAZTAC), led by the U.S. Chamber-based Brazil-U.S. Business Council and composed of agribusiness, manufacturing, and services companies and trade associations, sought to defeat both amendments and is now assessing how to ensure that the temporary agreement survives. The U.S. Chamber sent a letter to Congress stressing its opposition to any amendment that would result in the dismantling of the 2010 U.S.-Brazil temporary agreement.

Chamber Backs Expansion of ITA Product Coverage

On June 13, the U.S. Chamber submitted comments to the Office of the U.S. Trade Representative on possible negotiations in the World Trade Organization (WTO) to expand the Information Technology Agreement (ITA), and whether the United States should undertake such negotiations. In its submission, the U.S. Chamber strongly supported launching a new tariff-reduction initiative to expand product coverage of the ITA. While the information and communications technology sector has exploded with new and improved products since the ITA came into force, the product scope of the agreement has never been expanded. The U.S. Chamber believes an expansion of the ITA is an important step in the right direction.

Business Groups Back Capital Increases for Multilateral Banks

On June 7, six industry associations led by the U.S. Chamber sent a letter to Congress supporting authorizing and appropriations measures for capital increases for the multilateral development banks. The letter reads in part: "American businesses understand these institutions' vital role in fostering prosperity. MDB loans and expertise help developing countries become reliable trading partners and open up their markets for U.S. goods, and over half of all U.S. exports now go to developing countries that have received assistance from the MDBs. These loans come with conditions, such as strengthening transparency, promoting good governance, and improving the investment climate."

Resolución COMEX sobre Abono Tributario‏

Como adjunto encontrarán la Resolución Nro. 10 del Comité de Comercio Exterior (COMEX) que reconoce el Certificado de Abono Tributario (CAT) y detalla el procedimiento para que los exportadores se acojan a ese beneficio.

La Resolución es del 17 de mayo del 2011, sin embargo, al parecer todavía no ha sido publicada en el Registro Oficial para entrar en vigencia.

WTO Members Seeking Scaled Back Doha Package

Members of the World Trade Organization (WTO) have concluded that they will not meet their goal of concluding a Doha Round agreement by the end of this year and are now working to come up with a scaled back deal that could be approved at the WTO ministerial meeting in Geneva in December. However, there are widely divergent views about what a smaller package should include, as well as uncertainty about the fate of the other issues that would be left out, including market access for agriculture, industrials goods, and services.

U.S. Chamber Urges Reauthorization of Ex-Im Bank

In advance of the June 2 House Financial Services Subcommittee on International Monetary Policy and Trade Mark-Up to reauthorize the U.S. Export-Import Bank, the U.S. Chamber along with seven other organizations sent a letter to Chairman Gary Miller (R-CA) and the other Subcommittee members urging them to vote yes on the "Securing American Jobs Through Exports Act of 2011," which will reauthorize the bank. The letter reads in part: "We the undersigned write to encourage you to vote for the 'Securing American Jobs Through Exports Act of 2011' which will reauthorize the Export-Import Bank of the United States (Ex-Im Bank). This bill reflects a good faith effort to ensure a bi-partisan bill that will help grow and sustain U.S. exports and U.S. jobs, which is the mandate of the Ex-Im Bank. As the Bank's Charter expires on September 30, it is imperative that this bill move forward." Read full letter.

Treasury Reiterates Stance that China is not a Currency Manipulator

On May 26, in its second 2011 Semiannual Report on International Economic and Exchange Rate Policies, the United States Treasury Department retained its longstanding position that China is not a currency manipulator, though its currency remains substantially undervalued. In the report, Treasury again urged China to make "more rapid progress," but it noted that, accounting for China's rapid inflation, the yuan had appreciated roughly 9% against the dollar in the last year. Treasury also emphasized that more rapid appreciation of the yuan against the dollar could help China to counter inflation.

Governors Send Letter to White House in Support of Trade

On May 23, 25 governors sent a letter to President Obama and Congressional leaders in support of a robust trade agenda that includes passage of the pending trade agreements South Korea, Colombia, and Panama and support for the Trade Adjustment Assistance (TAA) program. The letter also calls for the renewal of fast-track trade negotiation authority to the President. The bipartisan letter, which was authored and organized by Governors Terry Branstad (R-IA) and Governor Christine Gregoire (D-WA), states: "As the chief executives of our respective states and territories, we appreciate how important international trade and investment are to the economic vitality of our jurisdictions, presenting important opportunities for workers, and enhancing our overall competitiveness. Export-related jobs pay better than non-exporting industries and, with nearly 95 percent of the world's consumers living outside of the U.S., exports have been the focus of increased job growth in recent years. Strong bipartisan leadership is needed to create opportunities for America's workers." Read full letter.
